1. Acceptance of Terms

By accessing or using EasyPostAI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and EasyPostAI.

2. Service Description

EasyPostAI is an AI-powered social media post design platform. Users describe a post idea, choose a visual style, and receive AI-generated branded visuals, captions, and hashtags optimized for Instagram, Facebook, TikTok, LinkedIn, and Pinterest. The Service also provides brand profile management, AI photo tools, and multi-language content generation.

3. Account Registration

• You may register for an account using your email address or via Google OAuth.
• You must provide accurate, current, and complete information during registration and keep your account information up to date.
• You are solely responsible for maintaining the security and confidentiality of your account credentials.
• Each account is for individual use only. Account sharing is not permitted.
• You must be at least 16 years old to create an account.
• You are responsible for all activity that occurs under your account.

4. Pricing & Credits

EasyPostAI operates on a credit-based system. Each post generation costs 4 credits. The following plans are available:

• Free plan exports include a watermark.
• Credits do not carry over to the next billing cycle. Unused credits expire at the end of each period.
• Annual billing is available at a 17% discount compared to monthly billing.
• Prices are in US Dollars (USD) and may change with at least 30 days' prior notice to active subscribers.

5. Acceptable Use

You agree not to:

• Generate illegal, harmful, abusive, threatening, or hateful content.
• Use the Service to create misleading, deceptive, or fraudulent content.
• Resell, redistribute, or sublicense AI-generated content as part of a competing service.
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms.
• Exceed rate limits, overload infrastructure, or otherwise abuse the API or platform.
• Create multiple accounts for the purpose of abusing free credits or circumventing plan limits.
• Use automated scripts, bots, or tools to access the Service without prior written permission.

Violation of these rules may result in immediate account suspension or termination without notice.

6. Intellectual Property

• You retain ownership of content you generate using EasyPostAI, subject to the licenses described below.
• You grant EasyPostAI a non-exclusive, worldwide, royalty-free license to display your generated content in marketing materials (such as the examples page, social media, or promotional content). You may opt out of this by contacting us at [email protected].
• The EasyPostAI name, logo, brand identity, and website design are the intellectual property of EasyPostAI and may not be used without written permission.
• AI-generated content may resemble other AI-generated content. We do not guarantee the uniqueness or exclusivity of any generated output.

7. AI-Generated Content Disclaimer

• All visual and textual content is generated using Google Gemini AI technology.
• The quality, accuracy, and appropriateness of AI-generated content may vary.
• You are solely responsible for reviewing, editing, and approving all content before publishing it on any platform.
• EasyPostAI is not liable for any consequences resulting from the publication of AI-generated content, including but not limited to inaccuracies, errors, or claims arising from third parties.
• AI may occasionally produce inaccurate text, inappropriate visuals, or content that does not match your intent. Always review output before use.

8. Payment & Billing

• All payments are processed securely by Polar.sh.
• Subscriptions are billed on a recurring monthly or annual basis, depending on the plan you select.
• You may cancel your subscription at any time from your account settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to your plan's features until that date.
• No partial refunds are provided for unused portions of a billing cycle.
• Failed payment attempts may result in temporary suspension of your account until the payment issue is resolved.

9. Refund Policy

• Refund requests are evaluated on a case-by-case basis and must be submitted within 3 days of the initial purchase.
• To request a refund, contact us at [email protected] with a valid reason for your dissatisfaction.
• Free plan users are not eligible for refunds, as no payment has been made.
• Refunds, if approved, will be processed through the original payment method and may take 5-10 business days to appear.

10. Limitation of Liability

• EasyPostAI is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
• To the maximum extent permitted by law, EasyPostAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
• Our total aggregate liability for any claims arising from your use of the Service is limited to the total amount you have paid to EasyPostAI in the 12 months preceding the claim.
• We do not guarantee uninterrupted, error-free, or secure access to the Service at all times.

11. Termination

• You may delete your account and terminate your use of the Service at any time from your account settings.
• We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.
• Upon termination, your account data (including generated content, brand profiles, and personal information) will be permanently deleted within 30 days.
• The following sections survive termination: Intellectual Property (Section 6), AI-Generated Content Disclaimer (Section 7), Limitation of Liability (Section 10), and Governing Law (Section 14).

12. Changes to Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will notify active users via email at least 14 days before the changes take effect. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of those changes.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or your use of the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the competent courts of jurisdiction.
